Terms & Conditions
The following applies to Attorneys and corporate companies
- NDA principles of non-circumvention will apply at all times. No circumvention to take place.
- Corporate clients/affiliates / & attorneys are not allowed to communicate with our service providers / medical experts.
- Any questions/queries should be raised with Med Care Holdings.
- All Attorney-clients or corporate clients of MED CARE HOLDINGS (MCH), agree to pay MCH as discussed between the two parties, and will not deviate from the agreed-upon payment agreement / contractual arrangement. If such deviation takes place, the contract between MCH and the respective client will be terminated.
- Should any corporate client/attorney firm continue to instruct MCH, in the absence of having signed our contractual agreement, however having been informed of the manner in which MCH operate, MCH will take it that such a referring party understands and agrees to the concept fee structure, terms & conditions of MCH.
- Should a corporate company or attorney firm instruct MCH on a particular matter, communication should only be directed to MCH, and by no means should our network service provider be contacted directly, in his / her private capacity.
- Under no circumstances should any corporate client or attorney firm, being part of the MCH network, having instructed MCH on any particular case, accept an invoice from any of our service providers, not having been the instructed party.
- All clients of MCH agree to send MCH a remittance slip every month after payment has been made, indicating for which case payment has been made.
- Breaching of any contractual terms as stating within the MCH contract will lead to termination of the client’s contract with MCH.
- As a client, you’ll agree to allow MCH to send you newsletters, up-dates for information sessions, workshops and courses, and updates on our latest support services offered to you.
- You agree not to distribute any intellectual property pertaining to the business of MCH to any member of the public/client that is not on our network.
- You agree not to contact our service providers for personal gain in a private capacity
- Should you agree to send us referrals, however should you not have signed your application form /contractual agreement pertaining to payment, you immediately agree to the terms and conditions of our company, and full payment upon invoice submission will be required.
The following applies to all service providers
- NDA principles of non-circumvention will apply at all times. No circumvention to take place and as a service provider, you agree not to contact our Attorneys / corporate clients for personal gain in a private capacity
- Service providers are not allowed to communicate with our attorneys / corporate-mandated clients unless communication has been facilitated via MCH.
- Any questions/queries should be raised with Med Care Holdings.
- All service providers on the MCH Network will invoice MCH according to the pre-arranged contractual agreement, as determined per a specific case referral.
- Service-providers will be paid, as soon as MCH’s has been paid by their client.
- No payment for non-arrivals
- Cancellations must be done 72 hours in advance if anything unexpected happens so that we can make additional arrangements, if not the service provider will be liable for a fee of R500.
- Service providers will allow MCH to make their specific details known to our clients / Attorneys / Corporate companies.
- The service provider is required to complete any given instruction within the time-frame indicated in the referral agreement, as send to them prior to the instruction.
- Should a service provider want to hold onto their report until payment, and should MHC be able to facilitate such an agreement with the client of MHC, such an agreement must be signed by the various parties involved, before being approved.
- MCH will not be held liable for any misconduct/ negligence by the medical professional / service provider to whom MCH referred the claimant/referral to.
- MCH will distribute case referrals amongst the network, according to the MCH case distribution protocol.
- MCH offers a convenient network of medical health professionals/service providers, who adheres to the ethical principles of the HPCSA and their respective professional bodies, which will be open to the clients of MCH, who requests to make use of their services via the MHC network, by signing a contract with MCH.
- Breaching of any ethical principles or professional guidelines as stipulated by the HPCSA or contract terms will lead to termination of the service provider’s contract with MCH.
- As a service provider, you’ll agree to allow MCH to send you newsletters, up-dates for information sessions, workshops and courses, and updates on our latest support services offered to you.
- If you’ve signed up onto the advanced level package as a service provider, you’ll receive automatic ambassador status.
- Ambassador tasks will be given to advanced level members, who may accept or reject such a task. However, by accepting such a task, your service provider ranking will improve, placing you in a higher category of network engagement, which will result in the service provider receiving more referrals.
- You agree not to distribute any intellectual property pertaining to the business of MCH to any member of the public/client that is not on our network.
- Should you agree to take on a referral from us, however should you not have signed our contractual agreement pertaining to that case, you immediately agree to the terms and conditions of our company, and your own terms and conditions in terms of payment will not apply.
MCH Referral Distribution protocol
Selection of Practice (or medico-legal expert on our network) for work:
- The practise needs to be on the advanced level membership package – meaning that they adhere to the advanced member criteria.
- Depending on availability
- Depending on geographical proximity
- Depending on willingness to assist
- Depending on the expertise of the specialist
- Depending on the client’s request
- Preference will be given to good responders to requests by MCH.
- Preference will be given to practices from which good feedback has been received.
- Referrals will be on an “as-and-when” basis.
